1. Agreement to Terms

By accessing or using Webspector ("the Service"), operated by Webspector ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Webspector is an AI-powered website audit tool that analyzes websites for conversion rate optimization (CRO), search engine optimization (SEO), and user experience (UX) issues. The Service scrapes publicly accessible web pages, runs automated analysis using AI models, and generates actionable reports.

3. Accounts

To access certain features, you must create an account through our authentication provider (Clerk). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes.

4. Subscriptions & Billing

Webspector offers free preview reports and paid subscription plans (Pro and Business) that unlock full analysis. Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge the payment method on file at the start of each billing cycle.

You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer refunds for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

• Use the Service to audit websites you do not own or have authorization to analyze
• Attempt to circumvent rate limits, access controls, or usage quotas
• Resell, redistribute, or commercially exploit audit reports without permission
• Use the Service to harass, defame, or harm others
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to access the Service beyond normal browser usage

6. Intellectual Property

The Service, including its design, code, AI models, prompts, and branding, is owned by Webspector and protected by intellectual property laws. Audit reports generated for you are licensed for your personal or internal business use. You may not claim ownership of the underlying technology or methodology.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that audit reports will be error-free, complete, or suitable for any particular purpose. AI-generated analysis is advisory — you are responsible for evaluating and acting on recommendations at your own discretion.

8. Limitation of Liability

To the maximum extent permitted by law, Webspector shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
